The Legislative Reform (Entertainment Licensing) Order Explanatory Document Published

Further to our recent article, the Government has now published the explanatory document for the legislative reform order.

 

The 122 page document outlines a lot of the technical details and background documents associated with the legislative reform but also some useful explanatory guidance on the various elements of regulated entertainment that will be subject to deregulation, these being:

 

Live music in relevant alcohol licensed premises and workplaces

 

LGA cash incentive scheme to publish premises licences data sets

The Local Government Association has launched a scheme, the local government open data incentive scheme, that provides monetary incentives for councils to publish data on specific themes in standard tabular formats.

 

The themes from for this year are:

 

  • Planning applications
  • Premises licences, and
  • Public toilets.

 

Under the scheme, Councils are paid £2,000 per theme for publishing data in the correct format. A further £1,000 is paid if a council publishes data for all three themes.

 

Anti-social Behaviour, Crime and Policing Act Statutory Guidance Published

The Home Office has today (21/7/14) published the statutory guidance to accompany the Anti-social Behaviour, Crime and Policing Act sections of which are due to commence in October 2014.

 

Whist the Act primarily deals with anti-social behaviour, there are elements relevant to licensing:

 

  • Public spaces protection orders – Replacement for, amongst others, Designated Public Places Orders.

 

New offence for assaults on workers selling alcohol

An amendment to the Criminal Justice and Courts Bill has been proposed to make it an offence to assault a worker who is required to enforce or comply with the Licensing Act 2003, either in the course of that worker’s employment or by reason of that worker’s employment.

The Legislative Reform (Entertainment Licensing) Order 2014The Legislative Reform Order to amend the provisions of the Licensing Act 2003 in respect of entertainment licensing was laid before Parliament on 8 July 2014 and comes into force on 6th April 2015.


The LRO will amend Schedule 1 and section 177A of the Licensing Act 2003 (“the 2003 Act”) to deregulate certain types of regulated entertainment in defined circumstances, as summarised below.
