Street Trading and Pedlary Laws: A joint consultation on draft regulations to repeal the Pedlars Acts (UK wide) and make changes to the street trading legislation in England, Wales and Northern Ireland

 

BIS today (23.11.12) launched a joint consultation on draft regulations to repeal all of the UKs Pedlars Acts and to make changes to the UKs street trading legislation.

The consultation follows on form the Government’s previous consultation on street trading law reform to ensure compliance with the requirements of the European Services Directive. The purpose of this consultation is to ensure that the street trading and pedlary regimes comply fully with the requirements of the Services Directive.

The consultation is seeking views on:

  • Repeal of the UK wide Pedlars Acts 1871 and 1881.
  • A new, clear and up to date definition of what behaviour constitutes acting as a peddler for the purposes of the pedlar exemption under the street trading regimes of England, Wales and Northern Ireland.
  • Changes to Schedule 4 to the Local Government (Miscellaneous Provisions) Act 1982 to ensure compliance with the Services Directive - (the street trading regime of England and Wales).
  • Changes to the Northern Ireland (Street Trading) Act 2001 to ensure compliance with the Services Directive.

Street trading legislation regulates the sale or offering for sale of anything or service (London) in a street.  Street trading is different from peddling in a number of ways but primarily a pedlar is an itinerant seller where as a street trader sells goods from a pitch.  Currently the Police is responsible for the licensing of pedlars whereas local authorities are responsible for the regulation of street trading.
