Anti-social Behaviour, Crime and Policing Act Statutory Guidance Published
The Home Office has today (21/7/14) published the statutory guidance to accompany the Anti-social Behaviour, Crime and Policing Act sections of which are due to commence in October 2014.
Whist the Act primarily deals with anti-social behaviour, there are elements relevant to licensing:
- Public spaces protection orders – Replacement for, amongst others, Designated Public Places Orders.
- New premises closure powers – To allow the police or council to quickly close premises which are being used, or likely to be used, to commit nuisance or disorder.
The statutory guidance sets out helpful guidance on what these powers are, the procedures to follow, the statutory tests, appeals and other relevant information for police and council officers to take into account when discharging their functions under the Act.
