Deregulation Bill

Home Office launch Local Alcohol Action Area (LAAA) projectThe Home Office has written to Local Authority Chief Executives inviting expressions of interest to take part in a LAAA project which aims to offer up to 20 areas with high alcohol-related harms help with local initiatives over a 15 month period.

DCMS Consultation on Further Entertainment ExemptionsThe DCMS has launched a consultation on further measures to exempt certain forms of entertainment.

Consultation on Abolition of Personal Licences The Government has launched a consultation on the future of personal licences today.  It is of the opinion that the current system of personal licences may not always be the most proportionate or effective way to ensure alcohol is sold responsibly.

The Local Authorities (Functions and Responsibilities) (England) (Amendment) Regulations 2013 has been published and will come in to force on the 1st of October 2013.

The government today (17/7/13) announced its plans for yet more amendments to the Licensing Act.

Jeremy Browne MP, Minister of State for Crime Prevention, outlined the Government's plans under three broad headings;

1. Targeted national action

Interim steps on summary review remains in force pending appeal – High CourtIn R (o.a.o. 93 Feet East Ltd) v Tower Hamlets LBC, the High Court confirmed that interim steps imposed on a summary review under the Licensing Act 2003 remained in force pending appeal.  This ruling confirms a similar ruling by a district judges (not associated with this case) in December 2011.

This week we reported that the Draft Deregulation Bill set out a proposal to exempt the exhibition of films in community premises.

Further proposals to amend Schedule 1 (provision of regulated entertainment) of the Licensing Act 2003 has been set out in the Draft Deregulation Bill which was published on the 1st of July 2013.

Clause 34 of the draft Bill proposes to exempt the exhibition of films in community premises if the following conditions are satisfied;

1. the entertainment takes place between 8am and 11pm on the same day,
